The evidentiary hearing concerning this Petition will be held on August 1, 2013, beginning at 10:00 a.m. at the Winnebago City Hall, City Council Chambers, 140 Main Street South, Winnebago, Minnesota before Administrative Law Judge Kevin Snell. This is a continuation of the first hearing in this matter held on September 13, 2012.

The only formal parties to this proceeding to date are the Petitioners, City of Winnebago, and Verona Township. The Petitioners have petitioned the State for authority to detach certain land.

Hanson, whose address is 4614 480th Avenue, Frost, MN 56033 as Personal Representative of the Estate of the Decedent in an Unsupervised administration.

Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

ORDINANCE NO. 13-08

CITY OF BLUE EARTH

AN ORDINANCE TO AMEND

SECTION 330 GAMBLING

OF THE BLUE EARTH CITY CODE TO UPDATE

SECTION PURSUANT TO STATE LAW

The City Council of the City of Blue Earth does ordain as follows:

SECTION I.

That Section 330 Gambling of the Blue Earth City Code is hereby repealed in its entirety to be replaced by a new Section 330 Gambling as set forth in Section II herein.

SECTION II.

That a new Section 330 Gambling of the Blue Earth City Code is hereby adopted, stating as follows:

330.01. Adoption of State Law by Reference. The provisions of Minn. Stat. Ch. 349, as they may be amended from time to time, with reference to the definition of terms, conditions of operation, provisions relating to sales, and all other matters pertaining to lawful gambling are hereby adopted by reference and are made a part of this ordinance as if set out in full. It is the intention of the Council that all future amendments of Minn. Stat. Ch. 349 are hereby adopted by reference or referenced as if they had been in existence at the time this ordinance was adopted.

330.02. City May Be More Restrictive Than State Law. The Council is authorized by the provisions of Minn. Stat. 349.213, as it may be amended from time to time, to impose, and has imposed in this ordinance, additional restrictions on gambling within its limits beyond those contained in Minn. Stat. Ch. 349 as it may be amended from time to time.

330.03. Purpose. The purpose of this ordinance is to regulate lawful gambling within the City of Blue Earth, to prevent its commercialization, to insure the integrity of operations, and to provide for the use of net profits only for lawful purposes.

330.04. Definitions. In addition to the definitions contained in Minn. Stat. 349.12, as it may be amended from time to time, the following terms
