1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff's Complaint against you is on file in the office of the court administrator of the above-named court. Do not throw these papers away. They are official papers that affect your rights. The City Council of the City of Blue Earth does ordain as follows:

SECTION I

That the City of Blue Earth is desirous in obtaining fee title to certain tracts of real property described as follows:

A tract of land in the Southwest Quarter of Section 5, Township 102 North, Range 27 West, in Faribault County, Minnesota described as follows:

That the property is currently owned by Robert Manske and Lynn Manske, husband and wife, William Manske, a widower, and Richard Manske and Linda Manske husband and wife who desire to sell the property to the City of Blue Earth for the purchase price of $850,245.00 so said land can be developed as a new commercial/industrial park by the City of Blue Earth and the Blue Earth Economic Development Authority.

SECTION III

That the Mayor and the City Administrator are hereby authorized to pay to Robert Manske and Lynn Manske, husband and wife, William Manske, a widower, and Richard Manske and Linda Manske husband and wife the amount of $850,245.00 in exchange for a Warranty Deed conveying the real property described in Section I above to the City of Blue Earth.

SECTION IV

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

That the Mayor and the City Administrator are hereby authorized to pay to BEISCO, Inc. the amount of $61,500.00 in exchange for a Warranty Deed conveying the real property described in Section I above to the City of Blue Earth.

SECTION IV

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

NOTICE OF HEARING ON REPAIR PETITION FOR COUNTY DITCH #24

TO ALL PERSONS INTERESTED IN COUNTY DITCH #24 IN FARIBAULT COUNTY:

YOU AND EACH OF YOU WILL PLEASE TAKE NOTICE that a repair petition has been filed by a landowner on County Ditch #24 with the Auditor of Faribault County, pursuant to Minnesota Stat. 103E.715 stating that said drainage system is out of repair, and

WHEREAS the Faribault County Board of Commissioners appointed an engineer to investigate options and the need for repair and whereas a hearing was held on September 10th, 2013 and whereas the engineer was directed to prepare a revised report and whereas that report is completed and on file with the Faribault County Auditor,

YOU WILL FURTHER TAKE NOTICE that a hearing will be held on December 13, 2013 at 1:00 p.m. in the Faribault County Ag Center Meeting Room, 415 South Grove St, Blue Earth, MN to consider the revised engineers report at which time all persons interested in said ditch system may appear and be heard and present arguments for or against the proposed engineer's repair report. A copy of that report is available for inspection at the County Auditor's office and can be found on-line at www.co.faribault.mn.us.

OCTOBER 15, 2013

1. All members were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of October 1, 2013.

3. Approved agenda of October 15, 2013.

4. Set start time of December 17, 2013 Faribault County Board of Commissioners regular meeting at 4:00 p.m. to accommodate the Proposed Property Tax public hearing at 6:00 p.m.

5. Approved request of S. Cory to attend a one day Ethics for Minnesota Assessors in New Ulm.

6. Motion to approve a quote from Dulas Excavating, Inc. of Wells of $10,000 to remove debris from Parcel No. 26.200.0850 in the City of Frost after obtaining proper permits failed. Commissioner Roper voted yes. Commissioners Groskreutz, Loveall, and Warmka voted no.

7. Accepted resignation of Steve Linde as Sheriff Deputy effective November 31, 2013.

8. Approved in-house posting of union full-time deputy in the Sheriff Department.

9. Accepted agreement with Martin County to participate in a study of restructuring transit goals in each county financed by the Minnesota Department of Transportation.

10. Adopted Resolution 13-PZ09-28 granting a conditional use permit to Midcontinent Communications for the installation of a fiber optic cable in the townships of Blue Earth, Emerald, Brush Creek, and Foster adjacent to County Highway 16 in Faribault County. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.

11. Accepted final payment of $24,878.67 to M & K Construction on SP 022-604-013 contingent upon final approval from the Office of Civil Rights.

12. Adopted right of way encroachment procedure policy.

3. Adopted Resolution 13-CB-29 authorizing the levy of 2014 ditch assessments. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.

14. Approved request from M. Murphy to attend a 1-day PREA train the trainer training in Shakopee.

15. Approved courthouse employees hosting an open house on November 8, 2013 and a light display on the lawn.

16. Meeting was closed to consider a real estate transaction bargaining and updating the board on union negotiations. Auditor Thompson gave synopsis of the closed session.

17. Approved payment bills totaling $306,545.84.

Discussion was held concerning the following:

1. Vanessa Steffl of Lutheran Social Service met regarding the Meals on Wheels program.

2. D. Fellows met regarding central services business.

3. M. Stindtman met regarding soil and water business.

5. Accepted resignation of Steve Bohling as citizen member on the Faribault-Martin Counties Human Services Board. The Chair appointed Loveall and Roper to serve on the replacement search committee.

6. Approved an SSTS loan to Rebecca Hoppe of Delavan on Parcel No. 15.013.0100 in the amount of $9,596.34.

7. Accepted Minnesota Department of Natural Resources snowmobile trail grooming grant for the 2013/2014 season in the amount of $38,400.

8. Approved application to the State of Minnesota Department of Revenue for the grant to reduce costs for the PRISM program.

9. Approved signatures on the State of Minnesota General Obligation Bond Finance Property Declarations for the county owned landfill property.

10. Approved final payment of $81,013.41 to Southern Minnesota Construction for contract completed.

11. Approved requests from D. Fellows to attend 2-day AMC annual conference in Minneapolis; from D. Babcock, M. Durkee, J. Franzen, and J. McDonald to attend a 1-day bridge safety inspection seminar in Mankato; and from D. Babcock to attend a 1-day bituminous street recertification in Mankato.

12. Approved January 1, 2014 through December 31, 2016 contract with the AFSCME union.

13. Meeting was closed for union negotiation discussion. Present were Commissioners Groskreutz, Roper, Loveall, Warmka, and Young, Central Services Director Fellows, Attorney Troy Timmerman, and Auditor-Treasurer-Coordinator Thompson. Synopsis of closed session was given.

14. Approved payment bills totaling $250,900.57.
